Class Action Alleges Siri is Slacking

Apple is being sued for Siri’s poor job performance. Frank Fazio has filed a class action lawsuit, which includes all plaintiffs “similarly situated,” alleging that Apple’s advertisements for its new virtual assistant are misleading.

Documents of Fazio’s filing with a District Court of Northern California were posted to Scribd.com.

  

Fazio purchased an iPhone 4S specifically for Siri but claims that the software did not work as it is shown in Apple’s television commercials.

In his complaint, Fazio argues that Apple’s television commercials depict users easily making appointments, booking restaurant reservations, learning guitar chords or how to tie a tie “with ease.”

Fazio contends the ads are “misleading, false and reasonably likely to deceive, have deceived” Fazio and others included in the class action. Fazio says he would not have purchased the iPhone 4S if it weren’t for Apple’s advertising of Siri.

Apple declined to comment on legal matters. At launch of the iPhone 4S and the introduction of Siri, Apple did say that the product was still in a beta, or testing phase.

Since launch of Siri, several competing applications  have sprung on other platforms, including Android and BlackBerry, as well as separate voice-activated virtual assistants on iOS.

Siri has also received its fair share of ribbing in online forums and in spoof ads posted to places like YouTube that appear to make fun of Apple’s lofty claims.
